TERMS AND CONDITIONS THE ASTM STANDARDS ON DISC^TM PRODUCT IS LICENSED BY THE AMERICAN SOCIETY FOR TESTING AND MATERIALS (ASTM) TO YOU, THE PURCHASER, FOR YOUR USE ONLY ON THE TERMS SET FORTH BELOW.

USE OF THIS PRODUCT INDICATES YOUR ACCEPTANCE OF THE TERMS OF THIS AGREEMENT. IF THESE TERMS ARE UNACCEPTABLE, OR IF YOU ARE NOT SATISFIED WITH THE PRODUCT, YOU MAY RETURN THE ENTIRE PRODUCT TO ASTM WITHIN 30 DAYS FOR A REFUND OF PAYMENT.

1. Product Description. ASTM Standards on Disc^TM Index contains HTML text, titles, scopes and index terms for all 74 volumes that comprise the collection of ASTM standards in the year 2000. The Database and the Software are herein collectively referred to as the Product.

2. License and Rights for Print Copies. You acknowledge that ASTM is the exclusive owner of the Product. ASTM, in return for a fee, hereby grants you a nonexclusive and non-transferable license to use the Product on a single computer station. The Product may not be transmitted or networked to other work stations. The Product fee includes a limited site license to print images of the ASTM standards for internal use only. Such print copies may only be made using a printer that is a part of and driven by the single computer station referred to above. The ASTM standards in the Database may not be distributed, in whole or in part, elsewhere. Photocopying of pages printed from ASTM Standards Source^TM is especially forbidden unless such privileges are arranged for under separate contract with ASTM or through the Copyright Clearance Center.

3. Copyright: Restrictions on Use and Transfer. The Database and the Software comprising the ASTM Standards on Disc product are copyrighted. THE PURCHASER MAY NOT USE, COPY, MODIFY, DECOMPILE, DISASSEMBLE, REVERSE ENGINEER, MERGE, OR TRANSFER THE DATABASE OR THE SOFTWARE IN WHOLE OR IN PART, EXCEPT AS EXPRESSLY PROVIDED IN THIS AGREEMENT. Neither the Database nor the Software may be distributed to others or transferred electronically from one computer to another over a network or used on any multi-terminal computer system. IF THE PURCHASER TRANSFERS POSSESSION OF ANY COPY, MODIFICATION, OR MERGED PORTION OF THE DATABASE OR THE SOFTWARE TO ANOTHER PARTY, THIS LICENSE IS AUTOMATICALLY TERMINATED.

4. Pricing. The fee in effect on the date of the purchase order shall govern the price paid by a purchaser. Taxes and shipping charges will be added to each invoice where applicable.

5. Payment. Payment is due from purchaser upon receipt of invoice. New purchases must be accompanied by a valid purchase order.

6. Title. ASTM retains title to all items supplied under this product.

7. Maintenance Service. In the event that any part of the product is defective or becomes damaged during use, ASTM will replace the defective or damaged components if they are returned to ASTM. ASTM will make all reasonable efforts to respond to customer inquiries.

8. No Warranties. ASTM makes no warranties that purchaser's use of the product materials will be error free or successful. ASTM MAKES AND PURCHASER RECEIVES NO WARRANTY EXPRESS OR IMPLIED, AND THERE ARE EXPRESSLY EXCLUDED ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ASTM SHALL HAVE NO LIABILITY WITH RESPECT TO ITS OBLIGATIONS UNDER THIS AGREEMENT FOR CONSEQUENTIAL, EXEMPLARY, OR INCIDENTAL DAMAGES EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Purchaser agrees that ASTM's liability is limited as set forth below in paragraph 9.

9. Limitation of Liability. The purchaser assumes sole responsibility for all use of the product and agrees to indemnify and hold ASTM harmless from any liability or claim of any person arising from such use. ASTM shall not be responsible for any loss or damage arising out of, or in connection with, the use of the product. ASTM's liability, if any, shall be limited to the paid purchase fee for the product that gave rise to the purchaser's claim. In no event shall ASTM have any liability for lost profits or for any other indirect, special, incidental, consequential, or punitive damages.

10. General. This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania and the United States of America. This Agreement is the complete and exclusive statement of the agreement between ASTM and purchaser and supersedes any proposed or prior agreement, either oral or written, and any other communication including any purchase order terms or conditions between ASTM and purchaser relating to the subject of this Agreement. This Agreement may be modified or supplemented only by a written document signed by ASTM and purchaser. Questions or correspondence concerning this Agreement may be directed to:

11. Force Majeure. ASTM shall not be liable for any delay or failure in performance resulting from any cause beyond their reasonable control, including without limitation, war, strikes, civil disturbances, and acts of God.
